Booking Terms and Conditions


1 Contract
1.1 The terms and conditions stated below govern all bookings that you (the person making the booking) place with us (Midas Hotel Network Ltd).
1.2 The person making the booking guarantees that he/she has the authority of all persons included in the booking to make the booking on their behalf, and that you are solely responsible for the payments due from every party member.
1.3 A booking means an order placed by you for the purchase of Hotel Accommodation, Car Hire, Insurance and / or Other Travel Services which is accepted by us in accordance with the terms and conditions outlined below.
1.4 No contract shall come into existence until the order, placed by you, has been accepted by us, and full payment has been taken for the order. We reserve the right to refuse, at our own discretion, any order you place with us.
1.5 All products and prices that we advertise are subject to availability.
2 Making a Booking Online
2.1 When making a booking online through our website you must provide us with all the information we require. It is your responsibility to ensure that all the information you supply is accurate and complete for both you and all the members of your party.
2.2 We require full payment from you at the time of booking and you must ensure that the debit / credit card you are using is your own and that you have sufficient funds to cover the cost of the booking.
2.3 When your order has been placed we will email you a "Receipt of Order" confirmation and reference number. If we accept your order we shall debit payment as authorised by you and send a confirmation invoice along with the necessary vouchers you require by email.
2.4 If we do not accept your order we will advise you accordingly.
3 Making a booking through our Telesales Service
3.1 When making a booking using our Telesales Service you must provide us with all the information we require. It is your responsibility to ensure that all the information you supply is accurate and complete for both you and all the members of your party.
3.2 We require full payment from you at the time of booking and you must ensure that the debit / credit card you are using is your own and that you have sufficient funds to cover the cost of the booking.
3.3 When your order has been placed we will provide you with a Booking Reference which you must quote during any correspondence with us. If we accept your order we shall debit payment as authorised by you and send a confirmation invoice along with the necessary vouchers you require by email.
3.4 If we do not accept your order we will advise you accordingly.
4 Payment Details
4.1 We accept payment by Switch / Debit Cards: Visa Debit, Visa Delta, Electron, Solo and Switch Cards.
4.2 We accept payment by all Major Credit Cards.
4.3 We accept personal and company cheques made payable to "Midas Hotel Network Ltd Trustees" for telesales bookings only. Note we will need 7 working days to process bookings made by cheque.
5 Dispatch of Travel Documents
5.1 Travel Documents will be dispatched by email after payment has been authorised.
5.2 For vouchers dispatched by Courier or Post an additional charge will apply to cover the cost incurred.
6 Amending Your Booking
6.1 Should you amend your confirmed booking a standard charge of �20 will apply.
6.2 All amendments made are subject to further limitations and charges which may be imposed by our supplier. We reserve the right to pass on to you any costs incurred from our suppliers when amending a booking on your behalf.
7 Cancelling Your Booking
7.1 Should you cancel your confirmed booking the following charges will apply:
More than 7 days prior to departure�50 or first night accommodation, whichever is greater
7 days prior to departure or less100%
7.2 The minimum cancellation charge is �50 regardless of the total booking value. When the total value of the booking is less than �50 a 100% cancellation fee will apply.
7.3 All cancellations made are subject to further limitations and charges which may be imposed by our supplier. We reserve the right to pass on to you any costs incurred from our suppliers when cancelling a booking on your behalf.
7.4 Unused or partial used products are non-refundable and cannot be claimed for after departure or on return from your trip.
8 Our Alteration / Cancellation of Your Booking
8.1 We reserve the right to amend the price and / or description of any services offered before a booking is made and full payment has been taken.
8.2 On occasion, an over-booking situation will occur with certain suppliers / hotels. In this instance we will offer you alternative products of a similar or better quality where possible without any additional cost to you.
8.3 If an amendment as outlined in 8.2 is necessary you will have the option of:
i)Accepting the amendment as offered
ii)Purchasing an alternative product from us with a refund / extra payment applicable as appropriate
iii)Cancelling your booking
8.4 If we cancel your booking prior to your departure and are unable to offer a suitable alternative (of equal or better standard) then you may be entitled to compensation as listed below:

In all the above cases our liability is limited to the rates of compensation listed above. No further claims will be accepted by us.
8.5 We reserve the right to cancel the contract between us if one or more of the order was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail/letter and re-credit to your account any sum deducted by us from your credit/debit card as soon as possible. We will not be obliged to offer any additional compensation for disappointment suffered.
9 Our Responsibility in respect of your holiday arrangements
9.1 We act as a booking agent for the third party suppliers of your holiday arrangements and hence have no liability whatsoever if your holiday arrangement is deficient. Nothing in this paragraph excludes our legal liability for personal injury or death resulting from our negligence.
9.2 Midas Hotel Network makes its best effort to ensure that all the information that appears on its website is accurate. However, Midas Hotel Network does not accept liability for any errors and/or ommissions and reserves the right to change the information published at anytime and without notice.
9.3 If a specific hotel facility listed on our website is paramount to your stay we recommend you confirm with the hotel directly to ensure that the required facility is still available for your visit.
10 If something goes wrong with your holiday arrangement
10.1 If a problem occurs during your holiday, you must immediately contact the relevant supplier in the first instance.
10.2 If the supplier cannot resolve the situation to your satisfaction you should contact us at our office in Croydon by telephone on 0870 44 500 50 or by fax on 020 8588 0703 so that we are allowed the opportunity to assist.
10.3 If your situation is not resolved at this time you must write to Customer Service Manager, Midas Hotel Network, 60 Alderton Road, Croydon CR0 6HJ within 28 days of your return quoting your reference number and giving all relevant information.
10.4 Failure to notify us in writing within the specified period may affect our ability to investigate the matter and could prejudice any right you have to a compensation claim.
11 Passport, Visa and Health Requirements
Passport, visa and health requirements can change so we strongly recommend that before you commence your journey, you check with the applicable Embassy to ensure that you and take all necessary documents with you to gain access to any country you visit or transit through. If you fail do so; you will be solely responsible for any cost, loss or damage, that you or we incur.
12. Appropriate Behaviour
12.1 It is your responsibility to ensure that you do not behave inappropriately or in a way to cause offence or danger to others or in a way that puts property of others at risk.
12.2 If your behaviour is inappropriate and causes offence or damage to others, we and/or our suppliers may terminate your holiday arrangements. Hence our and our suppliers responsibility will cease immediately and you will not be eligible for any refunds, compensation or reimbursement of any expenses you incur following such termination. Further, you will be liable to reimburse us for any expenses we incur as a result of such termination.
13 Special Requests
We will endeavour to pass on any special request you make to the relevant supplier but we cannot guarantee your special request.
14 Financial Security
We are members of the Travel Trust Association (Membership Number: U1477) and hence your booking is financially protected in full. 15 Telephone Calls
We reserve the right to randomly record telephone calls to ensure our service to you is constantly improved.
16 Personal Details
Any personal details we hold are subject to our privacy policy, which is incorporated into these terms and conditions. On occasion we may send you special offers by email/post. If you do not wish to particpate in this facilty you can opt out by unchecking the check box at time of booking, or by clicking the unsubscribe link on the email newsletter.
17 Special Events
In certain circumstances where special events (eg Olympics) are taking place our normal booking conditions may be subject to change.
18 Insurance
We strongly recommend that you, and all members of your party, take out suitable insurance to cover (as a minimum) the costs incurred if you make a cancellation, and the cost of assistance, including repatriation, in the event of an accident or illness during your trip. It is your responsibility to ensure the insurance you purchase is suitable and adequate for your needs.
19 Third Party Rights
A person who is not a party to these conditions shall have no rights under the contracts (Rights of Third Party Act 1999) to enforce any point of this agreement.
20 Law
These terms and conditions shall be governed in accordance with English Law and the English courts shall have exclusive jurisdiction to adjudicate any dispute that arises
